Trump admin helps xAI fight pollution lawsuit, says military needs Grok for war

The Trump administration is rallying behind Elon Musk's xAI Corp in its legal fight against a Clean Air Act lawsuit initiated by the National Association for the Advancement of Colored People (NAACP). According to the government, this lawsuit poses a threat to xAI’s data center, which is integral for operating Grok systems utilized by the military. The NAACP filed the lawsuit against xAI and its subsidiary MZX Tech in April, claiming violations of the Clean Air Act due to the operation of 27 gas turbines without the necessary air permits in Southaven, Mississippi. Notably, by mid-May, the count of unpermitted turbines had escalated to 57, with plans for additional installations, as highlighted in a June 12 court filing. The lawsuit alleges that the Colossus Gas Plant, which powers xAI's Colossus 2 data center, is critical for the functioning of the AI chatbot Grok. Concerns over health and noise pollution have been raised by the community in response to the operations of these gas turbines. In a recent court filing, attorneys from the U.S. Department of Justice urged a federal judge to dismiss the case, citing a determination from the Mississippi Department of Environmental Quality that the turbines do not require permits. The government’s filing argued that the lawsuit jeopardizes not only advancements in artificial intelligence but also the energy necessary for its operation. It further stated that the NAACP's efforts to disrupt the power supply supporting Grok could potentially endanger national security, as Grok is said to provide vital assistance to military operations. The court documents noted that xAI's Grok Gov Model played a significant role in targeted operations in Iran during Operation Epic Fury, demonstrating increased operational efficiency. Cameron Stanley, the chief digital and artificial intelligence officer for the Department of War, asserted that the Grok Gov Model possesses distinct capabilities not available in other AI models. In contrast, the Southern Environmental Law Center (SELC), representing the NAACP, criticized the government’s stance, arguing that it implies xAI should be permitted to disregard legal regulations simply based on the administration's support.
