Google proposes to open Play Store to more real-money games in India

In a significant move, Google has unveiled a plan to amend its Play Store and advertising regulations in India, allowing a wider array of real-money gaming applications to be featured on its platform. This proposal is part of an effort to resolve an ongoing antitrust dispute with the online gaming platform WinZO. On Wednesday, India’s competition authority announced a public invitation for feedback on Google’s 'commitment proposal', which seeks to broaden access to its Play Store and advertising avenues for real-money gaming applications in the region. Google intends to replace its existing pilot program, currently limited in scope, with provisions that would enable the distribution of all real-money games deemed permissible under Indian law. Developers will need to provide evidence that a recognized third-party organization has classified their games as 'games of skill'. The roots of this initiative trace back to September 2022, when Google initiated a pilot allowing daily fantasy sports and rummy games on its Play Store following a Supreme Court ruling that defined fantasy sports as 'games of skill' rather than gambling. However, WinZO subsequently filed a complaint, asserting that Google's restrictions unfairly excluded other real-money games. This led the Competition Commission of India (CCI) to launch a formal investigation into Google's practices concerning real-money gaming apps. In a previous announcement, Google expressed intentions to extend support for real-money gaming applications in markets like India, Brazil, and Mexico; yet, it paused this rollout in June 2024, continuing only with apps from the 2022 pilot in India. As part of its revised framework, Google plans to update its Developer Program Policies and establish a suitable business model for developers involved in real-money games. Additionally, it aims to permit advertising for 'games of skill', contingent on the provision of proof from third parties such as industry associations. Google has indicated that it will begin allowing compliant real-money games on its Play Store within 120 days following CCI approval, with associated advertising policy changes to be implemented within 150 days. A Google spokesperson commented on the proposal, highlighting their commitment to fostering a more transparent and secure environment for real-money gaming applications on their platforms. This proposal could also benefit Google financially by expanding its revenue streams from a broader selection of real-money gaming applications and their associated advertisements. As the real-money gaming sector constitutes a significant portion of India's online gaming market, accounting for around 86% of industry revenue, the anticipated changes could reshape the competitive landscape. However, the CCI's investigation into Google's practices is ongoing, and the outcome may influence the company's operational strategies in India. The tech giant continues to face various antitrust challenges in the country, having previously received fines related to its dominance in the Android market and the Play Store. Google is currently appealing one such ruling in the Supreme Court, with hearings expected next month. The company remains optimistic about its proposed framework's potential to empower Indian developers and enhance the digital economy while prioritizing user safety.
