FTC claims Gmail filtering Republican emails threatens “American freedoms”

Andrew Ferguson, the Chairman of the Federal Trade Commission, has raised serious concerns regarding Google's handling of political emails in Gmail. He claims that the tech giant employs a "partisan" approach to spam filtering, which results in Republican fundraising emails being diverted to users' spam folders, while Democratic emails consistently land in their inboxes. In a letter sent to Alphabet CEO Sundar Pichai, Ferguson expressed his belief that this behavior may violate the FTC Act by unfairly managing Gmail's spam filtering. This allegation echoes long-standing complaints from Republican circles, which had previously been dismissed by both a federal judge and the Federal Election Commission. Ferguson cited a recent report from the New York Post that highlights this issue, stating, "My understanding from recent reporting is that Gmail's spam filters routinely block messages from reaching consumers when those messages come from Republican senders but fail to block similar messages sent by Democrats." He warned that if Gmail's spam filters inhibit Americans from receiving expected communications or making donations, it could harm consumers and lead to violations of the FTC Act. Furthermore, Ferguson indicated that practices inconsistent with Google's obligations under the FTC Act might trigger an investigation and enforcement action from the FTC. He also noted in a footnote that such conduct could potentially breach state consumer protection laws. In response to these accusations, Google issued a statement clarifying that Gmail's spam filters operate based on various objective signals from users, such as whether emails are marked as spam or if a particular sender is flagged for sending high volumes of spam messages. They emphasize that this filtering process is applied uniformly, regardless of the sender's political stance. Google also conveyed their intention to review Ferguson's letter and engage in constructive dialogue regarding the matter.
