Trump administration stops illegal freeze of $5B EV charger funds after losing in court

In a significant turn of events, the federal government has released new guidance that enables states to access $5 billion earmarked for electric vehicle (EV) charging infrastructure. This decision comes after a prolonged period during which the funds were effectively frozen, prompting a coalition of states to take legal action against the administration. The funding freeze originated from the Trump administration's efforts to halt resources allocated by Congress at the beginning of Donald Trump’s second term. A pivotal court ruling in June indicated that the states involved were likely to prevail in their lawsuit, leading to an injunction against the funding halt. Criticism has been directed at the states for their slow progress in utilizing the funds, with the Department of Transportation (DOT), under the leadership of Sean Duffy, noting that as of May, approximately 84% of the allocated funds remained unspent and only a limited number of charging stations had been constructed. The DOT stated that the funding was paused for a review process to align the National Electric Vehicle Infrastructure (NEVI) program with the administration's goals. The latest press release outlines new guidelines that appear to streamline the approval process for establishing charging stations. Notably, states are no longer required to consider consumer protections, emergency evacuation measures, or environmental assessments prior to commencing construction. Moreover, the previous mandates to ensure that a percentage of the charging stations were situated in rural, underserved, or disadvantaged communities have been removed. Additionally, the updated guidance eliminates the need for proposals to demonstrate their commitment to robust labor standards, safety training, and the inclusion of minority and women-owned small businesses in the funding process. This shift marks a substantial change in how states can implement EV charging infrastructure, paving the way for accelerated deployment of charging stations across the country.
