
In a contentious move, the Federal Communications Commission (FCC) has given the green light for EchoStar to sell its spectrum licenses to major players AT&T and SpaceX, the latter operating the Starlink service. The transactions, totaling an impressive $40 billion, were sanctioned by the agency’s Wireless Telecommunications Bureau and Space Bureau, but have drawn ire from smaller telecommunications providers. This decision comes on the heels of FCC Chairman Brendan Carr's previous threats to revoke EchoStar’s licenses. The pressure arose after SpaceX alleged that EchoStar's subsidiary, Dish Network, was underutilizing its spectrum for mobile services in the U.S. While Dish had received an extension on its network deployment obligations from the previous administration, Carr voiced strong opposition to this arrangement. As a result of the escalating conflict, EchoStar negotiated substantial sales, with SpaceX acquiring $17 billion worth of licenses and AT&T securing $23 billion. The sale will enable AT&T to gain 30 MHz of nationwide spectrum in the 3.45 GHz band and an additional 20 MHz in the 600 MHz band, enhancing its capabilities for 5G and fixed wireless services. Meanwhile, SpaceX will obtain 65 MHz of spectrum licenses across various frequencies, aimed at strengthening its Starlink satellite mobile service for T-Mobile users. However, these transactions may not be smooth sailing just yet. EchoStar has expressed concerns over an FCC mandate requiring a $2.4 billion escrow account to cover compensation for construction companies involved in building Dish's network. While EchoStar’s Boost Mobile will continue offering wireless services, it will now operate on AT&T's network rather than its own, and will also access Starlink's mobile network through a new agreement with SpaceX. EchoStar has hinted at a potential challenge against the escrow requirement, indicating ongoing tensions in this complex situation.
