This admission came during a recent Senate Select Committee on Intelligence hearing, where FBI Director Kash Patel emphasized the value of the information gleaned from these purchases. This revelation marks a notable shift from the FBI's previous stance. In March 2023, former FBI Director Christopher Wray stated that the agency had stopped acquiring such data. He clarified that while the FBI had previously engaged in acquiring location data for a specific national security pilot project, that practice had not been active for some time. During the hearing, Senator Ron Wyden (D-Ore.) revisited Wray's earlier statements and pressed Patel for clarity on the agency's current practices. Patel confirmed that the FBI does indeed purchase commercially available information, asserting that it aligns with constitutional guidelines and the Electronic Communications Privacy Act. He maintained that this data has provided valuable intelligence for the agency. Senator Wyden expressed deep concern over the implications of this practice, describing it as a dangerous circumvention of the Fourth Amendment. He highlighted the risks associated with the FBI's reliance on location data, especially in the context of artificial intelligence being used to sift through vast amounts of personal information. The discussion raises critical questions about privacy rights and the balance between national security and individual freedoms.
