Snapchat sued in case alleging the platform is responsible for 12-year-old’s rape

The family of a Missouri girl is taking legal action against Snap Inc., the parent company of Snapchat, alleging that the platform played a role in facilitating her rape when she was just 12 years old. According to the lawsuit, features like Quick Add and Snap Map enabled the assailant, Gabriel Joel Valentin-Rios, to groom and connect with the victim, identified in court documents as J.F. Filed in Missouri state court, the lawsuit also names Valentin-Rios, who has already pleaded guilty to statutory rape and enticement of a minor, resulting in an 18-year prison sentence. This case adds to a growing list of lawsuits aimed at holding Snapchat accountable for incidents of sexual abuse reported by young users. Several families have previously pursued legal action against the platform, echoing similar claims of abuse facilitated by its design. In a notable case from 2024, New Mexico Attorney General Raúl Torrez accused Snap of creating an environment that allows for child sexual exploitation through its policies and features. While Snap asserts they have systems in place to combat abuse and have introduced features to protect minors, the Missouri lawsuit argues that the company has been aware of the risks yet has failed to take adequate preventive measures. The lawsuit cites a 133-page manual discovered on the dark web, which allegedly instructs predators on how to exploit Snapchat's features to target young users. The complaint suggests that such design flaws pose ongoing dangers to children. An attorney representing Snap has been reached for comments regarding the allegations. Matthew Bergman, founder of the Social Media Victims Law Center, emphasized the troubling reality that predators often utilize Snapchat’s features to find and exploit vulnerable children. He described the situation as a widespread issue of child sexual abuse facilitated by social media. The lawsuit details that J.F. began using Snapchat at the age of 11, unbeknownst to her parents. The complaint claims that Snapchat could have accurately estimated her age based on its data analytics, yet allowed her to interact with adult users. Shortly after signing up, the Quick Add feature recommended Valentin-Rios as a potential friend, misleading J.F. into believing he was a peer due to apparent mutual connections. The complaint states that Valentin-Rios initiated contact by sending explicit images to J.F., taking advantage of Snapchat's lack of a preview option for incoming content. Through Snap Map, he allegedly obtained J.F.'s home address, leading to further coercion and abuse. Valentin-Rios is accused of creating multiple Snapchat accounts to engage with minors, a violation of the platform’s policies that Snap reportedly did not enforce. The lawsuit also highlights internal documents suggesting that the company was failing to review a significant percentage of serious user reports concerning abuse. The family is seeking financial damages and aims to determine how many times Valentin-Rios' accounts were flagged for inappropriate behavior prior to the assault. As Snapchat and other social media platforms face a rising number of lawsuits regarding their impact on youth, a recent poll indicated that many young users encounter troubling content on these platforms. Despite claims of robust safety measures, public concern continues to mount, pushing for greater accountability and protective measures within the social media landscape.
