Ex-Intel engineer Varun Gupta fined $34,472 for leaking internal information to Microsoft

Varun Gupta, a former employee of Intel, has been sentenced to two years of probation and ordered to pay a fine of $34,472 for the theft and misuse of sensitive internal documents during his transition to Microsoft. This ruling was issued by US District Judge Amy Baggio, who opted against a prison sentence despite prosecutors advocating for eight months of incarceration. Gupta, who spent nearly ten years at Intel as a product marketing engineer, resigned in January 2020 to take a position at Microsoft. Prior to his departure, he illicitly copied close to 4,000 confidential files that included crucial information such as pricing strategies, analyses of competitors, and client presentations. Court filings reveal that these documents not only aided him in securing his new role but also provided Microsoft with an unfair edge in negotiations against Intel. The situation came to light when Intel staff observed that Gupta, now working for Microsoft, demonstrated an unusual understanding of Intel's internal operations. An investigation, which was supported by Microsoft, validated suspicions that Gupta had transferred confidential information to portable devices and his company-issued laptop. In February 2021, Intel initiated a lawsuit against him, which culminated in a confidential settlement where Gupta paid approximately $40,000. Criminal charges were subsequently filed in December 2024. Assistant US Attorney William Narus characterized Gupta's behavior as intentional and systematic, urging for a custodial sentence. Conversely, Gupta’s defense attorney, David Angeli, pointed out that his client had already faced significant financial and professional setbacks, highlighting that he did not share the stolen information with foreign entities nor did he profit from it. While acknowledging the gravity of Gupta's actions, Judge Baggio took into account the devastating impact on his career and reputation. The imposed fine of $34,472 was intended to mirror the cost of the prison time sought by the prosecution, serving as a warning against similar offenses. Following this legal turmoil, Gupta has relocated with his family to France, where he is pursuing studies in vineyard management, aiming to rebuild his life in the wine industry.
