Google dealt another legal blow by Epic Games: Here's what it could mean

Google has faced a setback as the Ninth Circuit Court of Appeals has upheld a federal court's decision requiring the company to revise its Play Store policies. This ruling comes as part of an ongoing legal struggle with Epic Games, the creator of Fortnite. It now paves the way for Epic to introduce its own app store within Google's platform. Judge Margaret McKeown, who supported the lower court's decision, emphasized that antitrust remedies often need to restrict lawful conduct to prevent ongoing anti-competitive practices. She stated, "The district court had within its basket of remedial powers the authority to require Google to deal with parties harmed by its anti-competitive conduct, including its competitors." In December 2023, a jury found in favor of Epic’s allegations that Alphabet enforced restrictive Play Store policies and engaged in anti-competitive strategies, such as incentivizing smartphone manufacturers and popular app developers to exclusively use its app store. Following the jury’s verdict, US District Judge James Donato mandated Google to restore competition within the Play Store. This includes allowing rival app stores, offering alternative payment solutions, and implementing additional reforms. Tim Sweeney, CEO of Epic Games, celebrated the ruling on X, declaring, "Total victory in the Epic v Google appeal!" He noted that the Epic Games Store for Android will soon be available within the Google Play Store, in addition to being accessible globally via their website. In response to the decision, Google expressed concerns about potential negative impacts on user safety and innovation within the Android ecosystem. The company stated, "Our top priority remains protecting our users, developers and partners, and maintaining a secure platform as we continue our appeal." As the appeals court's decision reinforces last year's federal court orders, significant changes are anticipated for the Google Play Store. Google plans to challenge the ruling in the US Supreme Court, but the landscape of app distribution on Android may be on the brink of transformation.
