Apple loses bid to pause App Store fee changes as case heads to Supreme Court

In a significant victory for Epic Games, a recent ruling by the U.S. Court of Appeals for the Ninth Circuit has allowed the Fortnite developer to continue its battle with Apple over App Store fees. The court has granted Epic's motion, which means Apple is now required to enable developers to implement external payment systems in their apps without imposing additional fees. Previously, Apple had been permitted to temporarily suspend these changes while awaiting a Supreme Court review. However, Epic Games criticized this move as merely a tactic to delay the inevitable. The latest ruling effectively overturns Apple's request to pause the enforcement of these changes, granting an advantage to developers and compelling Apple to adhere to the new fee structure for the time being. The outcome of this case is poised to have far-reaching implications, determining whether Apple can continue to charge fees on transactions made outside its U.S. App Store and, if so, establishing how much those fees might be. In a post on social media platform X, Epic celebrated the court's decision, highlighting a statement from the ruling that asserted, "Apple has failed to show good cause to sustain our prior stay order. Apple has not demonstrated that any proceedings on remand will cause it irreparable harm if our decision is not stayed." This suggests the court did not find compelling evidence that Apple would suffer significant damage if the changes remained in effect during the ongoing legal proceedings.
