As expected, Trump’s EPA guts climate endangerment finding

In a move that many anticipated, the Environmental Protection Agency (EPA) has declared its decision to revoke a significant analysis of greenhouse gases which has underpinned regulations on emissions from vehicles, power plants, and industrial sources. This analysis, known as the endangerment finding, was mandated by the U.S. Supreme Court in 2007 and finalized during the Obama administration. While it theoretically served as the basis for government regulations on carbon dioxide emissions, its real-world impact has been undermined by a series of lawsuits and shifting policies across different administrations. Interestingly, although the first Trump administration chose to maintain the endangerment finding, opting for a strategy of weak regulations rather than challenging its scientific basis—given the robust evidence of climate change driven by human activities—the second Trump administration took a more confrontational stance. It assembled a group of skeptics to craft a report that questioned the prevailing scientific consensus. However, this attempt faced significant backlash, both scientifically and legally. The recent announcement from the EPA dismisses the scientific underpinnings of the endangerment finding, labeling it as legally flawed. According to the agency, “The Trump EPA’s final rule dismantles the tactics and legal fictions used by the Obama and Biden Administrations to impose their ideological agendas on the American public.” This assertion raises eyebrows, particularly as the so-called “legal fictions” include a Supreme Court ruling that explicitly required the EPA to conduct an endangerment analysis.
