The ruling, delivered by US District Judge Jane Boyle, determined that Musk's claims lacked merit, as they did not demonstrate any harm to consumers—a critical requirement for establishing an antitrust violation. Judge Boyle stated that the lawsuit was dismissed because Musk failed to provide sufficient facts to support his assertion that advertisers were acting against their own interests by refraining from advertising on X. In her opinion, Judge Boyle emphasized, "The very nature of the alleged conspiracy does not state an antitrust claim, and the Court therefore has no qualm dismissing with prejudice." She also pointed out that the central issue in antitrust cases is whether consumers have been affected, rather than competitors. This ruling is particularly impactful for Musk, who previously suggested that advertisers should face criminal charges after a report from his allies in Congress accused them of intentionally undermining Twitter's revenue to silence conservative voices. The lawsuit was part of a larger legal battle Musk initiated against Media Matters for America, which he claimed was behind the ad boycott. While that case continues, the recent ruling may weaken Musk's position by establishing that there was no illegal boycott. As of now, Musk has not publicly responded to the court's decision, and X has not provided any comments regarding the matter. However, given Musk's history of outspoken remarks on legal issues, an appeal from X seems likely.
