Wazzan, recognized for his expertise in valuation and damages, asserts that Musk is entitled to a substantial share of OpenAI's current valuation of $500 billion. This figure stems from Musk's initial $38 million investment when he co-founded the company in 2015, suggesting a remarkable 3,500-fold return on his investment. Wazzan's evaluation takes into account Musk's early financial input along with the technical and business expertise he contributed to OpenAI's formative stages. He estimates that OpenAI's wrongful gains could range between $65.5 billion and $109.4 billion, while Microsoft, which holds a 27% stake in OpenAI, could owe Musk between $13.3 billion and $25.1 billion. Musk's legal representatives argue that he deserves compensation akin to that of an early-stage investor who typically enjoys returns vastly exceeding their initial stake. However, the enormity of Musk's damages claim suggests that this legal confrontation transcends mere financial restitution. With a net worth estimated at around $700 billion, Musk remains the wealthiest individual globally, significantly surpassing the second-richest person, Larry Page, by $500 billion, according to Forbes. In a related development, Tesla shareholders recently approved a historic $1 trillion compensation package for Musk, marking the largest corporate pay deal ever. Even if Musk were awarded $134 billion from OpenAI, it would be a minor increase to his already immense wealth. This context leads OpenAI to interpret the lawsuit as part of a broader pattern of harassment rather than a legitimate financial concern. As the legal proceedings move forward, OpenAI has reportedly warned investors and business partners that Musk is likely to make “deliberately outlandish, attention-grabbing claims” as the case is set for trial in April in Oakland, California, located just east of San Francisco.
