To beat Altman in court, Musk offers to give all damages to Open AI nonprofit

Elon Musk has recently amended his lawsuit against OpenAI and its CEO, Sam Altman, clarifying that any damages awarded should be directed to OpenAI's charitable nonprofit rather than to himself. Musk's attorney, Marc Toberoff, emphasized that Musk is not pursuing any personal financial gain from this legal battle. Toberoff explained to The Wall Street Journal that this adjustment aims to eliminate misconceptions that the lawsuit is intended to harass OpenAI, a company Musk co-founded but now views as a competitor. "He is asking the court to return everything that was taken from a public charity—and to ensure that those responsible cannot repeat such actions in the future," Toberoff stated. This revision is intended to clarify Musk's original intentions, which he believes have been misrepresented by OpenAI's communications. This shift in strategy comes in response to a recent ruling by US District Judge Yvonne Gonzalez Rogers, who warned that Musk's potential remedies could be significantly limited unless he altered his approach. A week before Musk's filing, the judge denied his request for punitive damages and expressed concerns about the calculations made by Musk's expert, which suggested that OpenAI and Microsoft had reaped wrongful gains totaling nearly $134 billion from Musk's initial $38 million donation. The judge concluded that Musk had not sufficiently argued for the recovery of those damages for personal benefit. It appears that Musk recognized the need to revise his claims in light of the judge's order, which also rejected his request to inform the jury about his perspective on how the damages accrued whenever the defendants utilized the benefits of his donations for purposes other than their intended charitable use.
