Amazon, Etsy, e-commerce stocks pop after Supreme Court tariff ruling

E-commerce shares experienced a notable uptick following a significant Supreme Court ruling that challenged the legality of President Trump's extensive global tariffs. In a decisive 6-3 vote, the court determined that Trump lacked the legal grounds to impose tariffs under the International Economic Powers Act (IEEPA), the legislation that many of these tariffs were based upon. Notably, the IEEPA does not specifically mention the imposition of tariffs. As a result of this ruling, Amazon's stock rose by over 1%, while Etsy's shares surged by 5%. Other platforms like Shopify, Wayfair, and eBay saw increases of more than 3%. Pinduoduo Holdings, which operates the budget-friendly marketplace Temu, also experienced a 3% boost in stock value. The tariffs, which have posed significant challenges for e-commerce platforms, disrupted the operations of businesses relying on online sales. Many companies have faced squeezed profit margins, leading to layoffs, price hikes, and significant restructuring of their supply chains. Additionally, Trump’s invocation of the IEEPA to eliminate the 'de minimis' exemption, which allowed low-value packages to enter the U.S. without tariffs, adversely affected small business owners on platforms like Etsy and eBay. The removal of this exemption threatened the operations of Temu and Shein, which previously utilized this loophole to ship goods directly from China to American consumers without incurring duties. In reaction, Temu temporarily halted direct shipments from China, although both companies have since expanded their seller networks and logistics capabilities within the U.S. The end of the de minimis exemption, alongside other sweeping tariff changes, has contributed to a decline in consumer confidence amid a challenging economic environment. Amazon CEO Andy Jassy highlighted in a recent CNBC interview that these tariffs have started to influence item pricing, with many consumers opting for lower-cost products while hesitating to purchase higher-priced discretionary items. In its annual report, Etsy acknowledged the pressure from shifting consumer spending habits, attributing it to a decline in discretionary spending. The company expressed concerns regarding the uncertain tariff landscape and its potential impact on consumer demand in its 10-K filing. Etsy’s CFO, Lanny Baker, indicated that the company’s forecasts assume economic conditions remain stable, yet their guidance for first-quarter gross merchandise sales was cautious. While Amazon and Etsy have yet to comment on the Supreme Court decision, the National Retail Federation welcomed the ruling, stating it provides essential clarity for U.S. businesses and manufacturers, allowing global supply chains to function without confusion. Companies may now pursue the recovery of billions in tariff fees, with some already initiating lawsuits in anticipation of the court's ruling. For instance, Apple has incurred approximately $3.3 billion in tariffs to date.
