Dutch government blocks US company from acquisition, citing ‘risk to public interest’

In a significant move, the Dutch government has intervened to prevent the acquisition of Solvinity, a local cloud services provider, by the American tech giant Kyndryl. This decision stems from concerns regarding the potential risk to public interest, particularly related to data security and sovereignty. Willemijn Aerdts, the Dutch minister for digital economy, communicated the government's stance in a letter published on Monday. The Dutch authorities have enacted a “complete prohibition” on the acquisition, which was set to allow Kyndryl to purchase Solvinity for an undisclosed amount. Solvinity is responsible for hosting DigiD, a crucial platform that enables Dutch residents to authenticate their identity when accessing government services. The acquisition raised alarms about the possibility of DigiD data being subjected to foreign control, raising fears that U.S. authorities could demand access to sensitive information. While specific reasons for the blockade were not detailed, this decision aligns with a broader trend in Europe where countries are becoming increasingly cautious about their dependence on American technology firms. The backdrop includes concerns over the unpredictable nature of U.S. government policies, particularly during the Trump administration, which has been known for its aggressive stance on data control. U.S. laws permit governmental bodies, including law enforcement, to request data from U.S. companies regardless of the data's geographical location, potentially undermining local data protection regulations. Kyndryl expressed its disappointment in the decision, indicating the impact such regulatory measures have on international business operations.
