Marketer that claimed it could tap devices for ad targeting will pay $880K settlement

In a significant turn of events, the Federal Trade Commission (FTC) has announced that Cox Media Group (CMG) will pay $880,000 to settle allegations of misleading advertising practices. The controversy revolves around CMG's marketing service, Active Listening, which claimed to utilize voice data from consumers' devices to deliver targeted advertisements. The claims made by CMG ignited concern among consumers and industry observers alike. The company's website boldly stated, "It’s true. Your devices are listening to you," suggesting that smartphones and smart TVs could capture conversations in real-time to enhance ad targeting. However, many experts, including those from 404 Media, raised skepticism about the feasibility of such technology. The FTC's investigation revealed that the service did not actually listen in on conversations or utilize voice data as claimed. Instead, CMG's offering was primarily centered around reselling email lists from other data brokers at inflated prices. The FTC's complaint emphasized that consumers were misled into believing that they had opted into a service that leveraged their conversations for ad targeting. In addition to CMG, two other marketing firms involved—Wisconsin-based 1010 Digital Works LLC and New Hampshire-based MindSift LLC—will each contribute $25,000 toward the settlement. Initially, CMG had touted its relationship with a partner capable of accessing microphone data, but a spokesperson later clarified that the company did not possess any capability to listen to conversations. This ruling serves as a reminder of the importance of transparency in advertising practices, particularly in the age of advanced technology and data privacy concerns.
