California defeats Tesla’s attempt to throw out racial discrimination lawsuit

In a significant legal development, a California judge has rejected Tesla's attempt to dismiss a lawsuit alleging racial discrimination, allowing the case to proceed to trial. The California Civil Rights Department (CRD) announced today that the Alameda County Superior Court's ruling opens the door for a trial set to take place on July 20. Kevin Kish, the Director of the CRD, emphasized the severity of the allegations, stating that Tesla's employment practices are reminiscent of some of the darkest aspects of the past. He pointed out that Black employees at Tesla reportedly earn less than their counterparts, endure racist insults, and face intimidation regarding their job security if they voice their concerns. "We look forward to having our day in court to hold Tesla accountable and to protect the rights of workers in our state," Kish remarked. The lawsuit, which claims extensive discrimination primarily at Tesla's Fremont factory, seeks both financial compensation and injunctive relief. It is set to address incidents of discrimination dating back to June 2018. Although the judge allowed some claims to be blocked due to the statute of limitations, this only applies to events occurring before June 18, 2018. The CRD initiated the lawsuit in March 2022 after a thorough three-year investigation. Their findings suggested rampant harassment, discrimination, and retaliation against Black employees at Tesla. Among the serious allegations are reports of frequent use of racial slurs in the workplace, often by supervisors and managers. Disturbingly, the Fremont factory has been described by employees as the ‘plantation,’ with Black workers derogatorily referred to as ‘slaves.’
