Judge probes whether Musk settlement with Trump admin is tainted by corruption

A federal judge has raised significant concerns regarding a settlement deal between Elon Musk and the Securities and Exchange Commission (SEC), indicating that the agreement may warrant deeper examination due to potential favoritism linked to the Trump administration. The settlement allows Musk to resolve a lawsuit by paying a $1.5 million fine, a considerable reduction from the initial demand of $150 million. This lawsuit stemmed from Musk's failure to disclose his acquisition of a 9 percent stake in Twitter within the legally mandated timeframe while he was in the process of purchasing the platform outright. The SEC's lawsuit, initiated during the Biden administration, alleged that Musk's delayed disclosure enabled him to continue acquiring shares at lower prices, ultimately costing shareholders over $150 million. Under the terms of the settlement, a trust named after Musk would cover the civil penalty without him admitting to any wrongdoing. During a recent hearing in the U.S. District Court for the District of Columbia, Judge Sparkle Sooknanan expressed her reluctance to approve the settlement, stating, "I am not going to rubber-stamp this settlement, and I cannot rubber-stamp this settlement." She questioned whether Musk was receiving preferential treatment in this case. Furthermore, Judge Sooknanan pointed out that the decision to lower the demand from $150 million and to impose the settlement on a trust instead of directly on Musk raised several red flags. She noted that SEC attorneys seemed taken aback when Musk’s legal team mentioned they were engaged in settlement discussions, highlighting additional inconsistencies that warranted further inquiry.
