Judge rules Anthropic did not violate authors' copyrights with AI book training

In a landmark ruling, a federal judge determined that Anthropic's practice of using books to train its AI model, Claude, is protected under the doctrine of 'fair use.' U.S. District Judge William Alsup stated that the use of copyrighted materials for AI training is considered 'transformative' and does not violate authors' copyrights. Judge Alsup emphasized that Anthropic's large language models do not replicate the creative elements of any specific work nor do they mimic an author's distinctive style. He noted that the act of using copyrighted texts to train AI models to generate new content aligns with the transformative purpose, akin to any aspiring writer examining existing literature. This ruling marks a pivotal moment for AI companies amidst ongoing legal challenges concerning the use of copyrighted materials in developing AI technologies. The decision sets a precedent for the industry, defining potential legal boundaries and opportunities for future AI development. The lawsuit originated in the U.S. District Court for the Northern District of California, filed by authors Andrea Bartz, Charles Graeber, and Kirk Wallace Johnson, who accused Anthropic of creating a substantial business by unlawfully utilizing hundreds of thousands of copyrighted books. Despite the favorable ruling for Anthropic regarding the training methods, Judge Alsup has ordered a trial concerning some pirated materials that the company included in its library, albeit not used for AI training. The judge clarified that while Anthropic’s later acquisition of a book it initially accessed illegally does not absolve it from liability, it might influence the determination of statutory damages.
