
In a significant development, a San Francisco judge has ruled that Don Lemon's lawsuit against Elon Musk and his social media platform X can move forward to trial. This decision comes after Musk's legal team attempted to shift the proceedings to Texas and sought to dismiss the allegations entirely. Judge Harold Kahn, in an order issued on July 8, stated that Lemon and his legal representatives have sufficiently established claims, including allegations of "fraud by false promise" and the existence of an "implied contract" between Lemon and Musk. The lawsuit, filed by Lemon in August 2024, follows the abrupt cancellation of a partnership by X, which occurred mere hours after Lemon's tense interview with Musk. The interview, intended to promote Lemon's new show on X, saw the former CNN anchor confront Musk on various controversial topics. These included Musk's controversial promotion of the "great replacement theory" and other inflammatory rhetoric, as well as questions regarding the platform's moderation policies and a noted increase in antisemitic content following Musk's acquisition of Twitter for $44 billion in late 2022. Since taking over the platform, Musk has implemented sweeping changes, including mass layoffs and the reinstatement of accounts previously banned for hate speech and violence incitement. Notably, he also restored former President Donald Trump's account, which had been permanently suspended after the events of January 6, 2021. Lemon's lawsuit is currently underway in San Francisco Superior Court, although a trial date has yet to be determined. Musk and X are also contending with multiple lawsuits relating to unpaid vendor bills and promises of severance to laid-off Twitter employees. Lemon himself faced termination from CNN in 2023 due to allegations of misconduct, which he later addressed with apologies.
