Anthropic loses appeals court bid to block Pentagon blacklisting temporarily

In a significant legal setback for Anthropic, a federal appeals court in Washington, D.C., has rejected the company's plea for a temporary stay in its ongoing lawsuit against the Department of Defense (DOD). The AI startup aimed to suspend its recent blacklisting by the Pentagon, which it claims is causing monetary and reputational damage as the case progresses. This ruling follows a separate decision from a San Francisco federal court, where a judge issued a preliminary injunction prohibiting the Trump administration from enforcing a ban on Anthropic's AI model, Claude. Earlier this year, the DOD labeled Anthropic a supply chain risk, asserting that the use of its technology could jeopardize U.S. national security. This classification mandates that defense contractors certify they do not employ Anthropic's Claude models in military-related work. The appeals court's decision articulated that the balance of interests favors the government, stating, "On one side is a relatively contained risk of financial harm to a single private company. On the other side is judicial management of how, and through whom, the Department of War secures vital AI technology during an active military conflict." Anthropic contended that the Pentagon's actions were retaliatory and unconstitutional, characterizing them as arbitrary and not adhering to legal protocols. The court recognized that Anthropic "will likely suffer some degree of irreparable harm absent a stay," but noted that the company's concerns appear predominantly financial. While Anthropic argued that the DOD's actions infringe on its right to free speech, the court found no evidence that the litigation has impeded the company's ability to express itself. The DOD's blacklisting is justified under two legal designations, which must be contested in separate courts. Anthropic has initiated a broader lawsuit in San Francisco federal court addressing one of these designations, where it recently secured a preliminary injunction based on allegations of First Amendment violations by the government.
