
In a significant escalation of trade tensions between the United States and China, the latter has declared that Nvidia has breached its antitrust laws. This declaration was made by China’s State Administration for Market Regulation on Monday and was initially reported by Bloomberg. The ruling pertains to Nvidia's 2020 acquisition of Mellanox Technologies, a networking equipment provider, for a substantial $7 billion. In response to the ruling, an Nvidia representative stated, "We comply with the law in all respects. We will continue to cooperate with all relevant government agencies as they evaluate the impact of export controls on competition in the commercial markets." While China has yet to impose any penalties connected to its findings, the investigation is ongoing. This ruling is expected to complicate the already delicate negotiations over tariffs between the U.S. and China, which are currently taking place in Madrid. Although these discussions do not focus solely on semiconductors, the accessibility of Nvidia's chips to China remains a crucial issue. The Biden administration had previously introduced an AI Diffusion Rule in January, aimed at limiting the export of U.S.-made AI chips to various countries, with additional restrictions specifically targeting China and other adversarial nations. Although this rule was officially repealed by the U.S. Department of Commerce in May, the landscape for AI chip exports to China continues to be uncertain. Earlier this year, the Trump administration established licensing requirements for chip sales to China, but those were relaxed in July, allowing companies to resume sales. However, a new agreement later mandated that companies selling chips to China must remit 15% of their revenue to the U.S. government. Meanwhile, China has taken steps to discourage its firms from purchasing Nvidia's products, resulting in a lack of sales as none of the company’s chips have successfully navigated the new export process during a recent earnings call.
