Tesla's insurance division is facing serious scrutiny from California's Department of Insurance (CDI) after allegations surfaced regarding chronic delays and denials of customer claims. Recent filings indicate that Tesla, in partnership with State National Insurance Company, has engaged in what the regulator describes as "willful unfair claims settlement practices," leading to significant distress for policyholders. Despite warnings from CDI dating back to 2022, the situation appears to have deteriorated. The regulator noted a staggering rise in complaints against Tesla's insurance services, with 2025 already surpassing the total number of justified complaints from the previous three years combined. The potential financial ramifications for Tesla and its partner could be severe, with penalties reaching up to $5,000 per unfair act and $10,000 for willful violations. The enforcement action could also have broader legal implications, particularly following a proposed class-action lawsuit filed in July, which accused Tesla of intentionally stalling and minimizing claim payouts. The regulator pointed out that these practices may expose Tesla to third-party liabilities. Tesla's foray into insurance began in 2019, aiming to provide lower premiums and improved service; however, the launch faced significant hurdles, including website crashes and unexpectedly high quotes. By early 2022, CDI had already begun addressing concerns with Tesla and State National regarding their claims handling. Key leadership roles, such as the Head of Claims, reportedly remained vacant for months, exacerbating the issues. After a six-month probationary period, wherein Tesla and State National promised to improve their claims processes, the situation did not improve as expected. An investigation revealed that complaints against Tesla surged dramatically, with 1,481 complaints reported by September 2023, resulting in nearly 3,000 identified violations of state insurance law since 2022. CDI's continued monitoring highlighted numerous failures in timely responses and investigations into claims, raising alarms over Tesla's commitment to rectifying its practices. The ongoing situation poses significant challenges for both Tesla and State National as they navigate the increasing regulatory pressure.
