GOP overhaul of broadband permit laws: Cities hate it, cable companies love it

A newly proposed initiative by Congressional Republicans is causing a significant stir among local government officials, who are expressing strong disapproval of what they characterize as an "unprecedented federal intrusion" into the regulation of broadband network construction permits. In stark contrast, this plan has garnered enthusiastic support from various cable industry lobby groups. Despite the resistance from local authorities and sharp criticism from Congressional Democrats, a House subcommittee has advanced the proposal. The legislation aims to automatically approve certain local telecom projects if municipalities fail to make a decision within a specified timeframe set by Congress. A coalition of four organizations, including the United States Conference of Mayors and the National League of Cities, shared their concerns in a letter to lawmakers, stating, "These bills represent an unprecedented federal intrusion into established local decision-making processes, favoring large broadband, telecommunications, wireless, and cable companies at the expense of residents and taxpayers." They argue that the legislation undermines local governments' ability to manage infrastructure effectively on local streets and in neighborhoods while placing no reciprocal obligations on service providers. During a markup hearing held by the House Commerce Committee's Subcommittee on Communications and Technology, local representatives voiced their objections to 11 of the 28 bills under consideration. The opposition centers on the bills' demands for cities to expedite permit approvals and lower fees for internet providers. Despite these concerns, the subcommittee approved all the proposed bills, sending them to the full Commerce Committee for further deliberation. Commerce Committee Ranking Member Frank Pallone, Jr. (D-N.J.) criticized the package, referencing its previous failure during the last Congressional session. He remarked, "The package is full of bad ideas that are unpopular with members on both sides of the aisle." Pallone highlighted that imposing arbitrary deadlines on state, local, and Tribal governments for complex permit reviews is met with widespread disapproval from local officials tasked with managing these processes. Additionally, he pointed out that certain provisions could severely limit local communities' ability to protect historic and culturally significant sites, particularly impacting Tribal communities.
