
In a significant move, Brazil's competition regulatory authority has mandated that WhatsApp pause its recent policy, which prohibits third-party artificial intelligence companies from utilizing its business API to provide chatbots on the platform. This decision comes alongside the initiation of an investigation aimed at assessing whether the policy constitutes anti-competitive behavior. The Conselho Administrativo de Defesa Econômica (CADE) expressed concerns regarding potential anti-competitive practices linked to the new WhatsApp Terms, referred to as the 'WhatsApp Business Solution Terms.' These terms, enacted by Meta, are under scrutiny for potentially favoring Meta AI, the company's own chatbot service, while limiting access for other AI tool providers. Meta revised its terms last October, effectively barring third-party AI companies, such as OpenAI, Perplexity, and Microsoft, from deploying their chatbots on WhatsApp as of January 15. However, businesses are still permitted to create and use their own chatbots within WhatsApp for customer interactions. CADE's investigation follows similar antitrust inquiries initiated by the European Union and Italy regarding Meta's new policy. Should the EU determine that Meta has violated its antitrust regulations, the company could face fines amounting to 10% of its global revenue. Interestingly, Meta has communicated to AI developers that they may continue offering their chatbots to users in Italy despite the forthcoming changes. This order from Brazil could lead Meta to adopt a similar approach in the country. The tech giant has previously stated that the integration of various AI chatbots is overwhelming its systems, which were originally designed for different functionalities within the business API. A spokesperson for Meta reiterated the intent behind the WhatsApp Business API, emphasizing its role in assisting businesses with customer support and relevant updates, while underlining their commitment to the large number of companies that are developing their customer interaction experiences on the platform.
