
Major tech players, including OpenAI, Meta, and Microsoft, are rallying for Congress to accelerate legislation aimed at reforming the federal permitting process for artificial intelligence infrastructure projects in the U.S. Advocates of the proposed SPEED Act contend that its passage is crucial for maintaining America's competitive edge against China and other nations in the AI sector. A pivotal procedural vote is scheduled in the House of Representatives, amplifying the urgency around this legislation. Chan Park, OpenAI's head of U.S. and Canada policy and partnerships, emphasized in a supportive letter that a streamlined permitting process is vital for companies investing in data centers and related infrastructure across the country. The SPEED Act would modify the 1969 National Environmental Policy Act (NEPA), which requires extensive federal reviews for projects that could impact the environment. Historically, attempts to reform NEPA have faced opposition from Democrats aligned with environmental advocates, while Republicans have pushed for business interests. However, increasing recognition of AI as a critical industry has led to a shift in some Democratic perspectives towards easing permitting hurdles. As the U.S. grapples with lagging AI infrastructure compared to China, calls for action have intensified. Representative Dusty Johnson, R-S.D., underscored the importance of reforming permitting processes to avoid handing advantages to competitors like China. He stated, "If we do not reform that, that will be a powerful gift that we are giving to China." Bipartisan support for the SPEED Act is evident, with co-sponsorship from House Natural Resources Committee Chair Bruce Westerman, R-Ark., and Rep. Jared Golden, a Democrat from Maine. The Data Center Coalition, representing major tech firms, advocates for comprehensive permitting reform as essential to winning the AI race and fostering economic growth in the U.S. Industry experts highlight the pressing need for improved energy infrastructure to support energy-intensive data centers. Cy McNeill, the Coalition's director of federal affairs, pointed out that existing transmission and generation limitations are hindering economic expansion. The SPEED Act proposes to shorten the timeline for federal reviews under NEPA and significantly reduce the statute of limitations for challenging permit decisions from six years to just 150 days. Proponents argue that this will minimize the potential for litigation that can delay critical projects. Despite the apparent bipartisan support, the SPEED Act faces challenges, particularly from the ultra-conservative House Republican Freedom Caucus, which opposes an amendment by Rep. Golden that would restrict a president's authority to revoke permits for energy projects. Freedom Caucus Chair Andy Harris, R-Md., has threatened to block the bill unless this amendment is removed. With Republicans holding a slim majority in the House, the outcome of the SPEED Act remains uncertain, especially as some Democrats seek additional assurances regarding clean energy projects. Representative Seth Magaziner, D-R.I., indicated that while a few Democrats might support the bill in its current form, broader backing will depend on addressing concerns about clean energy. As discussions regarding the Senate's approach to permitting reform continue behind closed doors, lawmakers are also considering removing barriers to interstate energy transmission projects. The path forward for the SPEED Act and broader permitting reforms is still being navigated, with both parties working to find common ground.
