
The Department of Telecommunications (DoT) has issued a stark warning to mobile phone users, highlighting the potential legal repercussions of SIM card misuse. Subscribers may find themselves facing serious legal action, including court appearances and hefty fines, if a SIM card registered in their name is exploited for cyber fraud or other illegal activities. This warning emphasizes that liability falls on the original subscriber, even if they have never actively used the SIM card. The DoT has outlined several risky behaviors that could lead to prosecution. These include using devices with altered or tampered International Mobile Equipment Identity (IMEI) numbers and acquiring SIM cards through fraudulent methods, such as submitting false documentation or impersonating someone else. Importantly, the DoT advises against transferring or lending out SIM cards, as this can easily facilitate cyber crimes. This caution comes in light of the recently enacted Telecommunications Act, 2023, which imposes stricter penalties for such offenses. Under this new legislation, tampering with telecommunication identifiers or participating in SIM card fraud can result in severe consequences, including prison sentences of up to three years and fines that could reach ₹50 lakh. The Act ensures that individuals who originally acquire a SIM may be held responsible as offenders if the card is later misused. To help the public mitigate potential risks, the DoT encourages users to take advantage of the government's Sanchar Saathi portal or mobile app. This resource allows subscribers to verify all connections linked to their names and check the authenticity of a device’s IMEI number, promoting a safer digital environment for everyone.
