Australia forces Big Tech firms to pay for news or face a 2.25% tax

Australia is taking decisive action to ensure that major technology companies contribute to the journalism industry. On Tuesday, the government introduced draft legislation mandating that firms like Meta, Google, and TikTok compensate news organizations for content that they aggregate or share. During a press conference, Communications Minister Anika Wells highlighted the trend of Australians sourcing their news directly from platforms like Facebook and TikTok. The proposed legislation, known as the News Bargaining Incentive (NBI), stipulates a 2.25% levy on the local revenues of these tech giants unless they negotiate commercial agreements with Australian news publishers. Notably, the more partnerships they form, the less they will owe; successful negotiations could reduce the effective rate to 1.5%. This could potentially inject between A$200 million and A$250 million back into the Australian journalism sector. Prime Minister Anthony Albanese emphasized the crucial role journalists play in informing communities, stating, "Journalists are the lifeblood of Australia’s media sector." This legislative effort marks Australia’s second attempt to compel Big Tech to financially support journalism. Previously, the News Media Bargaining Code was implemented in 2021, requiring payments from platforms like Google and Meta, but it had significant loopholes. For instance, companies could simply opt out by removing news content, a strategy Meta employed in 2024, leading to substantial job cuts in Australian newsrooms. The NBI aims to close these loopholes, imposing taxes regardless of whether news is featured on the platforms. Announced in December 2024 as an update to the 2021 Code, the draft legislation was finally revealed today. A significant addition to this new proposal is TikTok, which was not covered in the previous code. However, the draft specifically excludes AI services, with Assistant Treasurer Daniel Mulino stating that AI is currently being assessed through other policy discussions, particularly concerning copyright. The U.S. has historically opposed digital services taxes targeting American tech firms, with the Trump administration previously threatening tariffs against nations that implement such taxes. In response to inquiries about potential backlash from the White House, Albanese asserted, “We’re a sovereign nation, and my Government will make decisions based upon the Australian national interest.” Should the legislation pass, platforms will have until July to comply, coinciding with the start of the new tax. Australia is not isolated in its efforts; countries like Canada, Brazil, and members of the European Union have also challenged Big Tech regarding news content, yielding mixed outcomes. Canada’s recent law resulted in Meta removing news from its platform entirely, while Brazil’s proposal has stalled since 2019. Meanwhile, the EU has established regulations, though enforcement remains inconsistent. South Africa may serve as a model for Australia, having successfully brokered direct agreements with major tech companies, securing around $40 million for local news outlets over five years. Requests for comment from Meta, Google, and TikTok were not answered immediately.
