Arizona indicts prediction market Kalshi for running illegal gambling operation

Arizona's attorney general has initiated criminal proceedings against Kalshi, a prediction market platform, claiming it has been operating an unlicensed gambling business and facilitating illegal bets on elections within the state. Attorney General Kris Mayes expressed in a recent statement that despite Kalshi's branding as a 'prediction market,' its activities resemble those of an illegal gambling enterprise that violates Arizona law. This case marks the first instance of criminal charges being filed against Kalshi, although similar accusations have emerged from various other states regarding the legality of its betting markets. Legal expert Daniel Wallach noted that this development could trigger a ripple effect across the nation, indicating that while these charges are the first of their kind against Kalshi, they may not be the only ones to come. In response to the allegations, Kalshi defended itself, stating, "Unfortunately, a state can pursue criminal charges based on weak arguments. States like Arizona are attempting to regulate a nationwide financial exchange on their own terms and are resorting to various tactics to achieve this goal." Kalshi's platform allows users to buy shares in binary events, such as the outcome of sports games. The company contends that its contracts should fall under the purview of the federal Commodity Futures Trading Commission (CFTC), which would allow it to navigate around state-level sports betting laws by asserting that federal regulation takes precedence over state regulations.
