Electric air taxi maker Archer hits back at Joby in countersuit alleging concealed Chinese ties

Archer Aviation, the electric air taxi innovator, has taken a bold step by filing a countersuit against rival Joby Aviation. This legal move comes in response to Joby's accusations and claims that the competitor has misled the U.S. government and the public by falsely presenting itself as a purely American entity. In a federal court filing, Archer alleges that Joby has relied on a subsidiary in China for essential components, benefiting from support from Chinese suppliers and government resources. The accusations suggest that Joby has attempted to obscure its significant connections to China by misclassifying thousands of pounds of Chinese-manufactured aircraft materials as benign consumer goods, including hair clips and socks, in an effort to bypass U.S. tariffs and regulatory scrutiny. Joby, which was established in 2009 in Santa Cruz, California, maintains its headquarters there while also operating various facilities across the U.S. and internationally in locations such as Germany and China. In response to Archer's claims, Joby's attorney, Alex Spiro, dismissed the accusations as frivolous, stating that Archer’s ongoing legal troubles are leading them to concoct unfounded theories. He emphasized that they are prepared to defend themselves in court. This countersuit follows Joby’s previous lawsuit against Archer, alleging that a former Joby employee took proprietary trade secrets to Archer. Both companies, which went public in 2021 through mergers with special purpose acquisition companies, are vying for dominance in the burgeoning market of electric air taxis and related defense technologies. The timing of Archer's countersuit is significant, especially in light of a recent executive order from the Trump administration aimed at promoting the development of electric vertical takeoff and landing aircraft. Both Archer and Joby have applied to participate in a pilot program established under this directive, which seeks to advance the commercialization of air taxis in the U.S. The Department of Transportation and the FAA have already approved multiple proposals for this program, with Archer securing three approvals and Joby five. Archer's complaint highlights Joby’s substantial funding from U.S. government contracts, aiming to position itself as a leader in the air taxi industry amidst a backdrop of national interest in advancing drone technology.
