Apple opens up its App Store to competition in Japan

In a significant shift, Apple has announced plans to allow alternative app stores within Japan and grant developers the ability to handle payments for digital goods independently of its in-app purchasing system. This move comes as a response to Japan's new Mobile Software Competition Act (MSCA), which is set to come into force soon. Apple's decision is not born from a desire for greater openness but rather a necessity to comply with emerging regulatory frameworks. This change marks another instance where Apple's App Store revenue is under pressure from antitrust laws, following similar requirements in Europe under the Digital Markets Act (DMA). In the United States, the company has faced legal challenges that have compelled it to modify its payment processes, particularly after a lawsuit from Epic Games, the creator of Fortnite. Although the courts did not classify Apple as a monopoly, they mandated that developers should have the option to manage payments outside of Apple's ecosystem. In its statement about the updates in Japan, Apple cautioned that the introduction of alternative app marketplaces and payment methods could lead to increased risks of malware, fraud, and privacy issues. To address these concerns, Apple has collaborated with Japanese authorities to implement a notarization process for app marketplaces, aimed at safeguarding users, particularly children, from harmful content and scams. This initiative reveals that a technical solution for balancing security with openness has always been feasible. Despite these regulatory changes, Apple has devised a complex fee structure to minimize revenue losses while maintaining compliance with the law. Tim Sweeney, CEO of Epic Games, criticized these developments, stating that Fortnite will not return to iOS in Japan due to a hefty 21% fee imposed on third-party in-app purchases. He voiced his discontent on social media, condemning Apple's approach as a continuous pattern of obstruction and disrespect toward Japanese regulations and consumers. Sweeney contrasted Apple’s practices with those of other gaming platforms, questioning how regulators would react if Microsoft imposed similar requirements on games from other stores. Developers interested in these new options must agree to updates to the Apple Developer Program License Agreement by March 17, 2026, highlighting a new chapter in the ongoing battle for app store competition and developer rights in the tech industry.
