In a significant legal move, Apple Inc. has initiated a lawsuit in a Massachusetts federal court against a regional theater chain known as Apple Cinemas. The tech powerhouse accuses the cinema operator of infringing on its trademark rights and misleading consumers, as reported by MacRumors. The legal complaint outlines that Apple believes Apple Cinemas, along with its parent company Sand Media Corp Inc., is deliberately using the name 'Apple' to create confusion among consumers for its own gain. This lawsuit targets all locations operated by Apple Cinemas and its parent company, which was founded in 2013 and has primarily served the Northeastern United States. Recently, the chain expanded its reach by opening a theater in San Francisco, which Apple claims has exacerbated the situation. Apple's complaint highlights the cinema chain's plans to expand to a total of 100 locations across the nation, a move that the tech giant argues has led to significant public misunderstanding regarding its involvement with the theaters. "Given the Defendants' intentions to proliferate their theaters and the resulting public confusion about Apple's connection to them, we had no choice but to pursue legal action to safeguard our brand and customers from potential deception," the lawsuit states. Moreover, Apple asserts that prior attempts to settle the issue amicably were unsuccessful. The company reportedly sent several warnings, including a cease-and-desist letter in December 2024, and engaged in ongoing discussions to resolve the matter without going to court. Despite these efforts, Apple Cinemas continued to expand under the disputed name. The complaint also references various public comments on social media and news platforms, where individuals mistakenly believed that the cinema chain was affiliated with Apple. Additionally, the U.S. Patent and Trademark Office recently denied Sand Media Corp Inc.’s applications to trademark the names "Apple Cinemas" and "ACX - Apple Cinematic Experience," citing potential confusion with existing Apple trademarks. Apple’s legal representatives underscore that the company maintains substantial trademark rights over a wide array of products and services, including film distribution. Interestingly, the founders of the cinema chain initially selected the name in relation to a planned venue at Apple Valley Mall in Rhode Island, which was never realized.
