Apple reportedly agrees to submit India financials to CCI in antitrust case

In a significant development for the ongoing antitrust investigation in India, Apple has reportedly consented to provide the Competition Commission of India (CCI) with financial information specific to its operations in the country. This decision could potentially expedite the proceedings against the tech giant, which has faced scrutiny over its market practices. According to a report by Reuters, a confidential order from the CCI indicates that Apple accepted the request to submit its India-centric financial data last month. This marks a crucial moment in one of Apple's major regulatory battles in India, a market where the company has seen substantial growth in both iPhone sales and manufacturing efforts. During a hearing held on May 21, Apple's legal representation sought a "final extension" until June 25 to comply with the request for financial documentation. The CCI granted this extension, which underscores the ongoing nature of the investigation. This case stems from a CCI inquiry concluded in 2024, which found that Apple had reportedly misused its dominant position in the apps market for iPhones. Despite these findings, Apple has denied any allegations of misconduct and intends to contest the conclusions. Previously, Apple had been hesitant to share its financial details, contending that the investigation should be put on hold while it challenges India's revised framework for antitrust penalties. The company has argued that the regulations permit penalties to be calculated based on global revenues rather than revenue derived specifically from India. Reports suggest that the CCI had sought information regarding Apple’s worldwide financials, which could expose the company to fines potentially reaching $38 billion. However, the CCI has maintained its stance, asserting that it only required financial data pertinent to Apple's Indian operations. Furthermore, the commission has accused Apple of trying to stall the investigation through various legal maneuvers. A recent court directive reportedly instructed Apple to "cooperate" fully with the ongoing inquiry. The investigation was initiated in 2021 by a coalition that included non-profit organization Match Group, owner of Tinder, and the Alliance of Digital India Foundation (ADIF), which advocates for Indian startups. These entities raised concerns about Apple's App Store policies, particularly regarding its in-app payment mechanisms. During the May hearing, ADIF urged the CCI to prevent any further delays in the proceedings, emphasizing the urgency of the matter. Apple has also been requested to submit any objections it has regarding the findings of the investigation.
