Anthropic says the Pentagon’s supply chain risk label will have less business impact than feared

On Thursday, Anthropic addressed concerns regarding the Pentagon's classification of the AI firm as a 'supply chain risk,' asserting that the impact on their business relationships will be less severe than initially suggested by Defense Secretary Pete Hegseth. Hegseth had previously announced on social media that, following a breakdown in contract discussions, no contractors or partners associated with the U.S. military would be allowed to engage in commercial activities with Anthropic due to the new designation, typically used for companies with ties to foreign adversaries. However, Anthropic CEO Dario Amodei clarified that the Pentagon's letter indicates military contractors are restricted only from employing their AI model, Claude, directly in contracts with the Department of War, rather than across the board. The ongoing tensions between the Pentagon and Anthropic stem from the restrictions the company places on the deployment of Claude, which has been integrated into the military's classified networks. Concerns about a potential blacklist damaging Anthropic’s business were alleviated when the company highlighted that the relevant supply chain law narrows the implications of the Pentagon's designation. Amodei emphasized, 'Even for Department of War contractors, the supply chain risk designation doesn’t (and can’t) limit uses of Claude or business relationships with Anthropic if those are unrelated to their specific Department of War contracts.' Microsoft, a significant partner of Anthropic, echoed this sentiment. A spokesperson affirmed that their legal team reviewed the designation and concluded that Anthropic's products could still be offered to clients outside the Department of War through platforms like M365, GitHub, and Microsoft’s AI Foundry. A senior Pentagon official confirmed to CNN that the department had communicated the supply chain risk designation to Anthropic's leadership. The official stated, 'From the very beginning, this has been about one fundamental principle: the military being able to use technology for all lawful purposes.' The military aims to prevent any vendor from undermining command structures by limiting the lawful use of essential capabilities. In response to the Pentagon's actions, Amodei announced plans to contest the designation in court, arguing that it lacks legal grounding. The Pentagon sought a contract modification to ensure 'all lawful uses' for Claude, but negotiations faltered due to Anthropic's firm stance against the use of AI in autonomous weapons and mass surveillance of U.S. citizens. Despite the public dispute, Amodei noted that discussions between Anthropic and the Pentagon have resumed, expressing hope for a resolution. He also expressed regret over a leaked internal memo that suggested the discord stemmed from a lack of praise for former President Trump, stating that the tone of the memo did not reflect his views. In a show of solidarity, 30 former military and intelligence officials along with tech policy leaders issued a joint letter to Congress urging an investigation into the Pentagon's actions against Anthropic. Major tech trade associations have also voiced concerns regarding the potential repercussions of labeling a U.S. company as a supply chain risk, while various lawmakers criticized the administration’s approach, calling it shortsighted and damaging to national interests.
