Insurers balk at paying out huge settlements for claims against AI firms

OpenAI and Anthropic are exploring the possibility of utilizing investor capital to manage potential liabilities stemming from massive lawsuits, as insurance companies express reluctance to offer substantial coverage for the risks tied to artificial intelligence. Both AI startups currently maintain traditional business insurance; however, industry experts warn that these providers may find it challenging to secure adequate protection against the extensive damages they might face in the future. OpenAI, for instance, has partnered with Aon, the world’s second-largest insurance broker, to obtain coverage of up to $300 million specifically for emerging risks related to AI. While some sources corroborate this figure, a differing viewpoint claims the actual coverage is considerably less. Regardless, consensus indicates that the coverage remains insufficient in light of the potential losses stemming from a series of multi-billion dollar legal challenges. Aon refrained from commenting on specific companies, but Kevin Kalinich, the firm’s head of cyber risk, noted that the insurance industry generally lacks the capacity needed for AI model providers. He elaborated on the concerns insurers face, stating, "What they can’t afford to pay is if an AI provider makes a mistake that ends up as a systemic, correlated, aggregated risk." The insurance sector's reluctance to provide comprehensive coverage for AI companies is largely due to the unprecedented magnitude of potential claims confronting these relatively nascent tech firms. This hesitance is further exacerbated by the rising frequency of substantial damages, often referred to as "nuclear verdicts," levied against major corporations in the United States.
