UK judge warns of risk to justice after lawyers cited fake AI-generated cases in court

In a startling revelation, a UK judge has expressed serious concerns over the use of AI-generated fake cases in legal proceedings. High Court Justice Victoria Sharp indicated that lawyers who fail to verify their research could face prosecution for presenting fabricated information in court. During a recent ruling, Justice Sharp, alongside fellow judge Jeremy Johnson, condemned lawyers for allegedly relying on generative AI tools to produce legal arguments and witness statements without proper verification. This misuse poses a significant threat to the integrity of the judicial system and public trust. One striking example highlighted in their ruling involved a £90 million lawsuit concerning an alleged breach of a financing agreement with Qatar National Bank, where a lawyer cited 18 fictitious cases. The client, Hamad Al-Haroun, acknowledged that the false information stemmed from AI tools he accessed, taking full responsibility for the oversight rather than blaming his solicitor, Abid Hussain. Sharp noted the unusual nature of the lawyer depending on the client to verify legal research accuracy. In another case, a barrister involved in a tenant's housing claim against the London Borough of Haringey cited five non-existent cases. Despite her denial of using AI, Sharp remarked that she failed to provide a convincing explanation regarding her citation of the false information. Both lawyers have been referred to their respective professional regulators, although the judges did not impose harsher penalties at this time. Justice Sharp cautioned that presenting false evidence could amount to contempt of court or, in severe cases, perverting the course of justice, which could result in a life sentence. Emphasizing the dual nature of AI as both a tool and a potential source of risk, Sharp stated that its application in legal contexts requires stringent oversight and adherence to established ethical standards to maintain public confidence in the justice system.
