Legal fail: Don’t use AI to sue Facebook users for calling you a bad date

In a controversial legal attempt, an individual sought to pressure Meta into taking down a critical post from the Chicago Facebook group titled “Are We Dating the Same Guy.” This move may now result in sanctions against the attorneys involved, whose arguments appeared to lean on questionable AI-generated citations to support claims of doxing. The case had previously been dismissed with prejudice by a district court, which concluded that there was no possibility of amending the complaint to salvage it. Despite this setback, Nikko D’Ambrosio, who accused over two dozen women of defaming him and claimed that Meta profited by promoting the post for its entertainment value, decided to pursue an appeal. D’Ambrosio's confidence may have stemmed from his association with MarcTrent.AI, a law firm that asserts it utilizes artificial intelligence to unveil legal opportunities often overlooked by traditional firms and claims to enhance success rates by 35% through predictive modeling. In a blog post from 2025, founder Marc Trent acknowledged that the firm had employed its tech team to craft the initial complaint, emphasizing their heavy reliance on AI technologies. Trent expressed confidence that Meta would promptly remove the post, allowing them to sidestep potential obstacles posed by Section 230 of the Communications Decency Act. However, he later recognized that overcoming these legal protections would be a significant challenge. Nevertheless, he believed that his firm’s technological prowess would enable them to match Meta’s formidable legal team, well-trained in defending against Section 230 claims. Ultimately, during the appeal, judges unanimously agreed that the case lacked sufficient merit, rendering Section 230 considerations irrelevant. The reliance on AI to formulate arguments with precision did not seem to bolster the case in any meaningful way, highlighting the complexities and challenges of integrating technology into legal strategies.
