Kilcher's legal representatives argue that the case underscores how a prominent filmmaker exploited the biometric identity and cultural heritage of a young Indigenous girl without proper acknowledgment or compensation. Moreover, the lawsuit points out a stark contradiction: while the Avatar franchise has positioned itself as a proponent of Indigenous rights, it purportedly utilized the likeness of a real Indigenous actor without her permission. Kilcher recounted a brief encounter with Cameron shortly after the release of Avatar in 2009, during which he allegedly invited her to view a personalized sketch of Neytiri. In that meeting, he reportedly expressed admiration for her beauty, indicating that she had inspired the character's design. Kilcher's legal team has indicated that, despite multiple attempts by her representatives to secure an audition, she was never considered for any roles in the series. "It is unimaginable that someone I trusted would exploit my likeness in such a manner without my consent," Kilcher stated in the lawsuit. "This is a significant violation and profoundly wrong." The actress claims her awareness of the alleged misuse arose only last year when an old interview clip featuring Cameron resurfaced online. In that footage, he allegedly acknowledged Kilcher's influence on Neytiri's design.
