ABC fights Trump FCC’s attempt to control content of broadcast TV shows

ABC is taking a stand against the Trump administration's efforts to regulate content on broadcast television. The network argues that the Federal Communications Commission (FCC) is infringing on First Amendment rights. Under the leadership of Chairman Brendan Carr, the FCC has alleged that ABC's show, The View, is not adhering to the equal-time rule, despite the fact that interview segments of talk shows have traditionally been exempt from this requirement. This controversy escalated when the FCC initiated an unexpected review of ABC's broadcast licenses just one day after President Trump and First Lady Melania Trump called for the dismissal of Jimmy Kimmel over a joke he made. In a recent filing, ABC contended that the FCC has overstepped its authority, claiming that their actions could disrupt long-standing legal practices and chill protected speech, not only concerning The View but also in a broader context. While the filing primarily addresses the investigation regarding the equal-time rule, ABC appears to be equally committed to contesting the comprehensive license review. The network pointed out that in 2002, the FCC recognized The View as a legitimate news program, thereby exempting it from the equal-time rule, also known as the equal-opportunities rule. Although programs are not obliged to seek exemptions, ABC filed a petition for declaratory ruling in 2000 in anticipation of inviting more political candidates onto the show. Recently, the FCC Media Bureau instructed an ABC station to submit a new petition for declaratory ruling regarding The View's status, a demand that ABC argues is beyond the bureau's jurisdiction. In their filing, ABC detailed how the FCC is overreaching and violating broadcasters' First Amendment rights. "Some may disagree with certain—perhaps even most—of the views shared on The View or similar programs," ABC stated. "However, that disapproval does not justify employing regulatory measures to suppress those opinions. The risk lies in the government's potential to selectively regulate viewpoints. While the Commission scrutinizes The View's longstanding exemption, it has shown no intention to impose similar interpretations on other broadcasters, including diverse voices in the realm of broadcast radio."
